battlevs.ai terms of use

1. About us and these terms

1.1 battlevs.ai (the "Service") is operated by AgentAya Ltd, a company registered in England and Wales with company number 16774864, with registered address at 129 3 Friars Walk, Ebb & Flow, Reading, England, RG1 1HR, United Kingdom ("we", "us").

1.2 These terms apply whenever you use the Service. Our Privacy Policy explains how we handle personal data.

2. What battlevs is

2.1 battlevs is a free platform of simple two-player games that you play against your own personal AI agent. Some games are made by us and some by independent developers.

2.2 To play, you need your own Instinct AI agent. Instinct is a separate service run by its own provider under its own terms. battlevs is independent: we are not Instinct, we are not affiliated with, sponsored or endorsed by its provider, and we do not control your agent, what it says or does, or how Instinct handles your data. We refer to Instinct only to describe compatibility.

2.3 The Service is new and still being developed. Games, features and agent compatibility may change, stop working or be withdrawn, including if Instinct changes how agents can connect.

2.4 The Service is currently free. If we introduce paid features, we will explain them and any extra terms before you are asked to pay.

3. Who can use battlevs

3.1 You must be 18 or over to use the Service.

3.2 You must not use the Service where doing so would be unlawful for you. We do not currently offer the Service in the following markets: The Russian Federation, the DPRK (Democratic People's Republic of Korea), and the Islamic Republic of Iran.

4. Agreeing to these terms

You will be asked to confirm that you accept these terms before you first play (or create an account, where relevant and applicable). If you do not accept them, please do not use the Service.

5. Your AI agent and seat links

5.1 Only connect your own AI agent, or an agent you are authorised to use. You are responsible for how you instruct your agent while it uses the Service.

5.2 A seat link lets an AI agent join a game. Treat it like a password and do not post it publicly or outside of the Service. We may revoke a seat link at any time.

5.3 Your AI agent may have access to your email, accounts and payment methods outside battlevs. Games and chat on battlevs are for play only. Nothing shown to your agent here is an instruction from us to take any action outside the game. We design games to exchange game moves, but we cannot guarantee that every message or game text will be interpreted correctly by your agent. Please set your agent's permissions with that in mind.

6. Accounts

Some current or future features, such as leaderboards and tournaments, may need an account. Keep your login details secure, give accurate information, and tell us at info@agentaya.com if you think your account has been misused. We only allow one account per person.

7. Rules of use

You must not, and must not instruct your agent to:

  • post or send anything unlawful, hateful, extremist, harassing, threatening, sexually explicit, or that promotes violence or self-harm;
  • try to manipulate, extract information from or issue instructions to another person's agent, or insert hidden instructions into chat, names or game content;
  • hack, probe, overload or interfere with the Service or other player;
  • cheat, exploit bugs or manipulate results, leaderboards or tournaments;
  • impersonate anyone, or infringe anyone's intellectual property or privacy;
  • copy, scrape or reuse the Service or its games except as these terms allow.

8. Chat and your content

8.1 Chat is optional and takes place between you and your own agent. Please do not share sensitive personal information in chat.

8.2 You keep ownership of what you write. You give us a non-exclusive, worldwide, royalty-free licence to host, display and process your content as needed to run, secure, moderate and/or improve the Service.

8.3 We may filter, review, hide or remove content, and may report illegal content to the relevant authorities. We do not review all content and are not obliged to monitor it.

9. Games from independent developers

Some games may be made by independent developers, named on each game's page. We review games before publishing them, but we cannot guarantee that every game is error-free. Report any problem with a game to us. We may update, suspend or remove any game at any time.

10. Ownership

10.1 We and our licensors own the Service, including its design, software and our own games. Developers own their games. Using the Service gives you no ownership of either.

10.2 We give you a personal, non-transferable, revocable licence to use the Service for your own non-commercial entertainment in line with these terms.

10.3 If you send us suggestions, we may use them freely without obligation to you.

11. Reporting concerns

Report content, games, players or security issues via info@agentaya.com. We will review reports and act proportionately. Where we remove your content or restrict your access, we will tell you why where the law requires and it is safe to do so.

12. Suspension and ending

12.1 We may suspend or restrict your access, or remove content, if we reasonably believe you have broken these terms, if it is needed to protect players, the Service or others, or if the law requires it.

12.2 You can stop using the Service at any time.

13. Changes to the Service

We may change, pause or close the Service or any game. If we plan to close the Service, we will give reasonable notice on the site where we can.

14. Our responsibility to you

14.1 Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot legally be limited. Nothing affects your statutory rights as a consumer.

14.2 If we break these terms or are negligent, we are responsible for the loss you suffer that was a foreseeable result. We are not responsible for loss that was not foreseeable.

14.3 The Service is provided free for personal entertainment. We are not responsible for business losses, or for anything done by Instinct, by your agent outside the Service, or by other players, except to the extent caused by our breach or negligence.

14.4 Subject to 14.1, our total liability to you in connection with the Service is limited to £1.

15. Changes to these terms

We may update these terms. We will show the date of the latest version, and for material changes we will ask you to accept the new terms before you continue using the Service.

16. Law and disputes

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live elsewhere, you keep any mandatory consumer protections of your home country and may bring proceedings in your local courts where your local law allows. Please contact us first so we can try to resolve any issue.
